Ohio School Facilities Commission Claims Evaluation Services

The Ohio School Facilities Commission (OSFC) was created in May 1997 as a separate and distinct state agency to oversee the rebuilding of Ohio's public schools. In July 2007, the Commission had more than 300 school facilities under planning or in construction with an additional 500 facilities to be constructed in the next three years.

Beginning in August 2007, H.R. Gray was selected by the Ohio Schools Facilities Commission to provide Claims Evaluation Services for a two year period. Under this contract, H.R. Gray is responsible for reviewing and evaluating unresolved disputes and providing recommendations to the Commission in order to avoid and minimize additional costs. Services include scheduling analysis and forecasting, time/impact studies, as-built windowing analysis, productivity impact and cost impact studies as well as entitlement recommendations. H.R. Gray’s services also include developing presentation charts and exhibits, negotiation/mediation support, litigation support if needed and training on dispute management.

One major challenge is ensuring that OSFC has all the information that they are entitled to from the contractor so that they are making an informed and fair decision about any claims that arise. H.R. Gray thoroughly reviewed each project specific contract and project documentation in order to provide the client with enough information to make their decision. Another challenge encountered is the moving of information through the many layers of decision making – through a construction manager or architect – to make certain that the claim being reviewed remains a top priority. Persistence and follow-up has been the key to success in obtaining the information needed from the contractor.
